    Comment Ziel ist die Erleichterung der erfolgreichen Arbeitsmarktintegration von Personen, die unter die Richtlinie 2001/55/EG über vorübergehenden Schutz für aus der Ukraine geflohene Personen fallen. Im Einklang mit Artikel 12 der Richtlinie über den vorübergehenden Schutz: Die Mitgliedstaaten gestatten Personen, die durch den vorübergehenden Schutz begünstigt werden, für einen Zeitraum, der die Dauer des vorübergehenden Schutzes nicht überschreitet, die Ausübung einer abhängigen oder selbständigen Erwerbstätigkeit vorbehaltlich der für den jeweiligen Beruf geltenden Vorschriften sowie die Teilnahme an Maßnahmen wie Bildungsangeboten für Erwachsene, Berufsausbildung und praktische Erfahrungen am Arbeitsplatz. Aus arbeitsmarktpolitischen Gründen können die Mitgliedstaaten EU-Bürgern und Staatsangehörigen von Staaten, die durch das Abkommen über den Europäischen Wirtschaftsraum gebunden sind, sowie rechtmäßig ansässigen Drittstaatsangehörigen, die Arbeitslosengeld beziehen, Vorrang einräumen. Die in den Mitgliedstaaten geltenden allgemeinen Rechtsvorschriften über das Arbeitsentgelt, den Zugang zu den Systemen der sozialen Sicherheit im Zusammenhang mit einer abhängigen oder selbständigen Erwerbstätigkeit und die sonstigen Beschäftigungsbedingungen finden Anwendung.

    Comment Aimed at facilitating the successful labour market integration of beneficiaries of the Temporary Protection Directive 2001/55/EC for people fleeing from Ukraine. In line with Article 12 of the Temporary Protection Directive: Member States shall authorise, for a period not exceeding that of temporary protection, persons enjoying temporary protection to engage in employed or self-employed activities, subject to rules applicable to the profession, as well as in activities such as educational opportunities for adults, vocational training and practical workplace experience. For reasons of labour market policies, Member States may give priority to EU citizens and citizens of States bound by the Agreement on the European Economic Area and also to legally resident third-country nationals who receive unemployment benefit. The general law in force in the Member States applicable to remuneration, access to social security systems relating to employed or self-employed activities and other conditions of employment shall apply.

    Comment L'initiative vise à faciliter l’intégration réussie sur le marché du travail des bénéficiaires de la directive 2001/55/CE relative à l'octroi d'une protection temporaire pour les personnes fuyant l’Ukraine. Conformément à l’article 12 de la directive relative à l'octroi d'une protection temporaire: «[l]es États membres autorisent, pour une période ne dépassant pas la durée de la protection temporaire, les personnes qui en bénéficient à exercer une activité salariée ou non salariée, sous réserve des règles applicables à la profession choisie, ainsi qu'à participer à des activités telles que des actions éducatives pour adultes, des cours de formation professionnelle et des stages en entreprise. Pour des motifs tenant aux politiques du marché de l'emploi, les États membres peuvent accorder la priorité aux citoyens de l'UE et aux citoyens des États liés par l'accord sur l'Espace économique européen, ainsi qu'aux ressortissants de pays tiers en séjour régulier qui bénéficient d'allocations de chômage. Le droit commun en vigueur dans les États membres s'applique en ce qui concerne les rémunérations, l'accès aux régimes de sécurité sociale liés aux activités professionnelles salariées ou non salariées, ainsi que les autres conditions relatives à l'emploi».
